1. Agreement to Terms

By accessing or using PenStreak ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. These terms apply to all visitors, users, and others who access or use PenStreak.

2. Description of Service

PenStreak is a speed-reading trivia application that allows users to:

• Generate AI-powered quizzes from study materials using Cerebras AI technology
• Play interactive true/false trivia games with adjustable reading speeds
• Share quizzes with others via unique share links
• Track personal quiz scores and learning progress
• Compete with others on shared quizzes

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

3. User Accounts and Responsibilities

To access certain features, you must create an account through our authentication provider (Clerk). You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information during registration
• Notifying us immediately of any unauthorized access or security breach

You must be at least 13 years old to create an account. Users under 18 should have parental consent to use the service.

4. Acceptable Use Policy

You agree not to use PenStreak for any unlawful purpose or in any way that could damage, disable, and overburden the service. Prohibited activities include:

• Attempting to manipulate quiz scores, leaderboards, or game results through cheating or exploitation of bugs
• Uploading or sharing content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Using automated scripts, bots, or scrapers to access or interact with the service
• Attempting to gain unauthorized access to any part of the service or related systems
• Interfering with other users' enjoyment of the service
• Uploading study materials or creating quizzes containing copyrighted content without proper authorization
• Sharing personal information of others without their consent

Violation of this policy may result in immediate termination of your account.

5. AI-Generated Content

PenStreak uses artificial intelligence (Cerebras) to generate quiz questions from user-provided study materials. You acknowledge that:

• AI-generated content may occasionally contain errors, inaccuracies, or inappropriate material
• We do not guarantee the accuracy, completeness, or educational suitability of AI-generated quizzes
• You should verify important information independently before relying on it
• We are not responsible for any consequences resulting from incorrect AI-generated content

6. User-Generated Content

When you create and share quizzes on PenStreak, you retain ownership of your original study materials. However, by sharing a quiz, you grant us:

• A non-exclusive, worldwide, royalty-free license to store, display, and distribute the quiz content to users who access it via your share link
• The right to use anonymized quiz data to improve our AI models and service

You represent that you have the right to share any content you upload and that it does not violate third-party rights or applicable laws. Shared quizzes may be publicly accessible to anyone with the link.

7. Payment and Subscription Terms

PenStreak offers both free and paid subscription plans. By subscribing to a paid plan:

• You agree to pay all applicable fees as described at the time of purchase
• Subscriptions are processed through our payment provider (Polar)
• All payments are non-refundable except as required by law or as explicitly stated otherwise
• We reserve the right to change pricing with reasonable notice
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period

We may offer free trials or promotional pricing at our discretion. Abuse of promotional offers may result in account termination.

8. Intellectual Property

The PenStreak service, including its software, design, logos, trademarks, and original content (excluding user-generated content), is owned by us and protected by intellectual property laws. You may not:

• Copy, modify, distribute, or create derivative works of our service without written permission
• Use our trademarks or branding without authorization
• Reverse engineer or attempt to extract the source code of our software

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use the service immediately ceases
• Your account data may be deleted in accordance with our Privacy Policy
• Any shared quizzes you created may be removed from the platform
• All provisions of these Terms which by their nature should survive termination shall survive

You may delete your account at any time through your account settings.

10. Disclaimer of Warranties

PenStreak is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:

• The service will be uninterrupted, timely, secure, or error-free
• AI-generated quiz content will be accurate, complete, or reliable
• Any errors in the service will be corrected

Your use of the service is at your sole risk.

11. Limitation of Liability

To the maximum extent permitted by law, PenStreak and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses
• Any reliance on AI-generated content or quiz results
• Unauthorized access to or alteration of your transmissions or data
• Any other matter relating to the service

Our total liability shall not exceed the amount you paid us in the past twelve months, or one hundred dollars ($100) if you have not made any payments.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Delaware for resolution of any disputes.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after any changes constitutes acceptance of the new Terms.
